[Maul] Funny situation

This arose from watching Wellington 7s. Red ball carrier goes into contact with blue defender. Both stay on feet but it is unlikely the ball will come out as both players have hands on the ball. Another blue (defender) player joins the contact. (No maul due to definition). Blue players pick up red player off feet and march down the field. In the example I was watching a red player eventually joined the mass of players and managed to stop the drive - maul formed then and called and once it collapsed (no penalty offence) a scrum was called. My question is - could a red player have "sacked" this drive rather than having had to join the standing up contact. I think as a player I would probably have defended that way. As a referee this feels wrong, but what is the offence? Foul play - tackling a player without the ball?
