Jennings appeal upheld and ban lifted.

The IRFU released a statement that read: “The three-man IRFU appeal committee found that, under the Magners League tournament rules, and particularly the disciplinary rules therein, that no jurisdiction is given to a disciplinary committee to investigate a citing complaint of a citing commissioner appointed under those rules.

“As a result, the appeal of Shane Jennings is allowed and the suspension lifted. Shane Jennings is free to play from this point on.”

What this says, in effect, is that it is not written anywhere in the rules governing the Magners League – it is understood, but not written – that a disciplinary hearing should arise in the event of a citing during the match.

Opinions? Better or worse than the French letting ERC-cited player play while suspended?

Its a loophole which is a disgrace and we need to get it sorted. Good smart play by Jennings legal team

Red faces somewhere within Magners organising committee and a lot of citing officers with nothing to do for a while !

Perhaps Magners used the same Guinness sodden youth trainee to write the Magners Disciplinary section that wrote the summer 2008 ELV documentation.

Just shows why so many Unions and Competition organisers use the RFU Reglations and Rules as a pro forma.

This is an organising committee error and removes the citing option.

What has happened with the ERC issue is a suspended player in one competition has played in a national one - a gentleman would have appealed and suggested he was allowed to play whilst it was under dsicussion, not take unilateral action.

The latter is far more serious as it is challenge whereas the former is incompetence !
