Remembering the kick is awarded for a penalty, in the same vein as thinking on the "non kick" argument, having to take the penalty again and in the proper fashion might be considered punishment enough?

You risk losing some of the advantage you might have been seeking in any quick tap attempt, without actually nullifying the penalty itself. It still asks searching questions of the player taking the kick, "Am I making it clear enough for people to see?".

This would in in my view, be a proportionate response in the first instance.

It's a talking point rather than me looking to bat it back and say the laws are wrong. I accept the scrum is the application. I may not agree with it but it doesn't nessarily mean the book cannot be updated to reflect changes thinking on the matter in the future.
